I operate Jurismart, a brand of dispute resolution services in the nature of mediation of intellectual property disputes as well as a vehicle for professional coaching and marketing services. My credentials include coaching training at New York University’s Department for Leadership and Human Capital Management. My legal career has run the gamut from paralegal to partner. I earned an LL.M. from Columbia Law School with distinction as a Harlan Fiske Stone Scholar. As a lawyer in private practice, my responsibilities included prosecution, counseling and litigation related to a wide variety of trademark and copyright matters. I counseled in-house attorneys, business executives and individual proprietors on trademark, trade dress and advertising issues relating to adoption and proper use of trademarks, infringement, fair use, domain names, privacy and publicity rights, promotional campaigns and product packaging claims. In the area of technology, media and communications, I represented publishers in all aspects of their web businesses, including infrastructure design and privacy and data security issues. I also handled multimillion dollar software licensing transactions on behalf of major hospital systems, healthcare companies and leading data management and distribution companies covering applications from leading vendors; structured and negotiated system implementation agreements (software, hardware and other equipment, professional services and systems management agreements); drafted and reviewed website policy statements and terms and conditions; drafted and negotiated website development and content licensing agreements; and structured data distribution agreements for financial services companies. As an in-house attorney I regularly supported the sales teams in negotiating price, deliverables, service and length of contract as well as in identifying, communicating and managing risks and opportunities around specific contracts. My efforts in these areas were recognized with an award for outstanding service to the sales and account teams. I am licensed to practice law in New York and New Jersey and am qualified to practice in England and Wales. I have served in leadership positions in bar associations, taught legal courses at two colleges and authored several articles for legal periodicals, book publishers and general interest magazines. My most recent books include Understanding Trademark Law: A Beginner’s Guide, Understanding Copyright Law: A Beginner’s Guide, and Understanding Patent Law: A Beginner’s Guide, originally published by Oxford University Press and now available through Thomson Reuters’ Westlaw imprint.
In addition to my coaching practice, I am a business branding strategist, consulting with businesses and business owners on brand selection, promotion and enforcement.
